Terms of Use for Red Panda: RPG

1. Introduction

These Terms of Use ("Agreement") govern your access to and use of the mobile game Red Panda: RPG, developed by Lysiak Anhelina operating under the brand 237Mhz Games ("Developer", "we", "our"). By accessing or using the Game, you agree to be bound by this Agreement. All communications with us will be conducted solely in English. If you do not agree with any part of these Terms, you must immediately discontinue use of the Game and delete it from your device.

2. Acceptance of Terms

By using the Game, you acknowledge that you have read, understood, and unconditionally accepted these Terms of Use in full. Continued use of the Game constitutes your ongoing acceptance of any modifications to these Terms.

3. Accession to the Terms

Before using the Game – including viewing any of its content – you must fully read and agree to the following documents:

  • Terms of Use
  • Privacy Policy
  • End User License Agreement (EULA)

By proceeding to use the Game, you indicate your acceptance of all the above documents.

4. User Conduct and Obligations

  1. Age Requirement: You must be at least 12 years old to use the Game.
  2. In-App Purchases: For users making in-app purchases, you must be of the legal age as defined by your jurisdiction or have the express consent of a parent or legal guardian.
  3. Parental Control: Parents are responsible for enabling and ensuring the proper operation of parental control functionalities on in-app purchases. By accepting these Terms of Use, both children and their parents agree to take all necessary measures to enable such controls on their devices and monitor their functionality.
  4. Lawful Use: You agree to use the Game in accordance with all applicable laws and regulations.
  5. As-Is Provision: You acknowledge that the Game is provided "as is" with its inherent advantages and disadvantages.
  6. Enforcement: We reserve the right to enforce full or partial restrictions on your account (i.e., complete or partial blocking) if your behavior violates these Terms, including cheating or disruptive conduct that harms our community. In such cases, we are not obligated to provide any evidence or explanation regarding the enforcement decision.

5. License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to download, install, and use the Game for your personal, non-commercial purposes. You agree not to modify, copy, distribute, or reverse-engineer the Game in any manner.

6. Intellectual Property Rights

All content, including graphics, design, and code, in the Game is the property of Lysiak Anhelina or its licensors. Certain portions of the source code and resources are provided under the MIT License, which is detailed in the in-game Credits section. You are granted no rights in or to the Game except as expressly provided in this Agreement.

7. Disclaimer of Warranties and Limitation of Liability

  • The Game is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation of the Game.
  • We expressly disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
  • In no event shall we be liable for any direct, indirect, incidental, special, or consequential damages arising out of your use of, or inability to use, the Game.
  • We reserve the right to change the balance, game mechanics and all details of the in-game process at our sole discretion without prior notice or consultation with users. By playing the Game and/or making in-game purchases, you acknowledge and agree that the Game may change, either partially or completely, and that any funds spent on in-game purchases are non-refundable due to such changes.

8. Termination

We may terminate or suspend your access to the Game at any time, with or without cause, and without prior notice. If you do not agree with these rules, you must immediately discontinue use of the Game and delete it from your device. In the event of termination due to a breach of these Terms, you will not be entitled to any refund or compensation for any in-app purchases made.

9. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Ukraine. Any disputes arising out of or related to this Agreement shall be subject to the exclusive jurisdiction of the courts located in Kharkiv, Ukraine.

10. Miscellaneous

These Terms constitute the entire agreement between you and the Developer regarding your use of the Game. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Our failure to enforce any provision of these Terms shall not be deemed a waiver of our right to enforce such provision in the future.
